How is stepparent adoption different from third-party adoption in Kentucky?

Stepparent adoption in Kentucky is a shorter, more streamlined process than third-party adoption, because the court is formalizing a family that already exists. Both are filed in Circuit Court, but the steps and requirements differ.

What stepparent adoption looks like in Kentucky:

  • Home study waived. Kentucky waives the home study for stepparent adoptions (KRS § 199.473).
  • No separate termination case. Ending the other parent's rights is not a separate proceeding. It is handled within your adoption petition.
  • No waiting period for residents. Kentucky residents have no minimum residency period before filing. Non-residents need 12 months in the state (KRS § 199.470).
  • Timeline of 3-6 months is typical for a stepparent adoption.
  • Typical cost. Court filing fees run about $150-$300, and the total cost is typically under $1,000. Hiring an attorney commonly runs $3,000-$5,000+.
  • Your spouse must consent to the adoption.
  • The other legal parent either signs a consent form or you ask the court to dispense with consent.
  • A child who is 12 or older must consent (KRS § 199.500).
  • Abandonment. Kentucky has a short abandonment period. Three months, or 90 days, of no contact can establish grounds to proceed without that parent's consent (KRS § 199.502).
  • If the other parent can't be found, Kentucky allows service by publication after a diligent search. Otherwise, service is by sheriff or process server.

What you'll need to file:

  • A Petition for Adoption
  • Consent forms, or a motion to dispense with consent
  • Your spouse's consent to the adoption
  • Criminal background checks through the Kentucky State Police for the petitioners

How third-party adoption differs:

A third-party adoption usually means adopting a child you are not already parenting as a stepparent, so you are not simply formalizing your existing role in the child's life. The steps, requirements, timeline and costs for that route depend on the agency or attorney involved and on the child's circumstances. Ask the agency, an adoption attorney, or the Circuit Court clerk in your county about them, rather than assuming they match the stepparent process above. Kentucky has 120 counties, and local procedures can vary a little from one to the next.

When to get individualized help:

If the other parent is likely to object, or if you're unsure whether abandonment applies in your situation, a contested case depends on specific facts. The Circuit Court clerk can explain local filing procedures, and an attorney can advise you on your particular circumstances.
