How does PCS move affect stepparent adoption in New Jersey?

A PCS move does not add a waiting period to a stepparent adoption in New Jersey, because the state has no minimum residency period (N.J.S.A. § 9:3-42). If you have just arrived on orders, you do not have to wait a set number of months before starting your paperwork.

If you are moving to New Jersey:

  • Your adoption is handled by the Superior Court in the county where you file. New Jersey has 21 counties, and the clerk's office in your county can tell you how it handles filings from newly arrived families.
  • The typical stepparent adoption timeline here is 3-6 months, so plan around your expected time at the duty station.

If you may PCS away during the case:

  • A move can affect travel to the final hearing. Whether the court will allow a remote appearance, or keep your case once you have left the state, is not something we can promise. Ask the Superior Court clerk in your county before you move.
  • If your child is 10 or older, the child attends the final hearing and the court considers the child's wishes. New Jersey does not require the child's consent. Factor your child's travel into your moving plans.
  • Filing before your orders take effect gives you the most time, but confirm your schedule with the clerk.

What does not change with a move:

  • New Jersey waives the home study for stepparent adoptions (N.J.S.A. § 9:3-48), so you do not need to schedule a home visit around your move.
  • Consent from the other legal parent, or a way to address the other parent's rights, is still part of the process. Under N.J.S.A. § 9:3-46, the abandonment period is 6 months. If the other parent will not consent, or you cannot locate them, the right path depends on your facts. Talk to the court clerk or an attorney about that specific issue.

Military benefits: Whether your child becomes eligible for military dependent benefits after the adoption is governed by military rules, not New Jersey adoption law. Confirm the details with your installation's ID card office or personnel office, and ask what paperwork they want, such as a certified copy of the adoption decree. For a new birth certificate after the adoption, the New Jersey Office of Vital Statistics and Registration is the agency that handles it.

Costs: The court filing fee typically runs $200-$350, and the total cost is typically under $1,000. Attorneys commonly charge $3,000-$5,000+ for the same adoption.
