How do I serve adoption papers on a parent in a foreign country from Alabama?

In Alabama, you serve a parent who lives in another country by filing your stepparent adoption in the Probate Court and giving that parent formal notice, either by personal service or, if you truly don't know where they are, by service by publication.

Personal service. If you have a current address abroad, personal service is the route to use. The practical details of delivering papers in another country depend on where the parent lives, so ask the Probate Court clerk in your Alabama county, or an attorney, which delivery method the court will accept for that country and what proof of service it wants.

Service by publication. Alabama allows publication when the parent's location is unknown. It is meant for situations where you have no usable address, not for cases where you simply find it inconvenient to reach someone. Whether your efforts to find the parent are enough is a fact-specific question, so check with the clerk or an attorney before relying on it.

Consent or grounds for implied consent. Your filing needs either consent forms or grounds for implied consent. If the parent is willing to cooperate, a signed consent may be simpler than a contested process. If you are relying on the parent's absence, Alabama's abandonment period is 4 months (Ala. Code § 26-10E-9(a)(1), (a)(4)). Whether your facts meet that ground is something to confirm with the court or an attorney, especially if the parent might object.

Other pieces of your filing:

  • A petition for adoption.
  • Your spouse's consent to the adoption.
  • Consent from the child if the child is 14 or older (Ala. Code § 26-10E-7(a)(1)).
  • A home study, which Alabama does not waive (Ala. Code § 26-10E-26(2)).

Residency. Alabama has no minimum residency period for stepparent adoption filings (Ala. Code § 26-10E-5(e)(3)), so you can begin as soon as your paperwork is ready.

Timeline and cost. Stepparent adoptions in Alabama typically take 3-6 months. Because notice to a parent overseas can take extra time, ask the clerk how long the court expects it to take. Court filing fees run $200-$350, and a typical total cost is under $1,000, compared with $3,000-$5,000+ for an attorney.

When to talk to an attorney. If the parent objects, if you can't tell whether their address is reliable, or if you're unsure whether publication is appropriate, a local adoption attorney or the Probate Court clerk can advise you on that specific issue. The clerk can't give legal advice, but they can explain local filing and service procedures.
