A death certificate proves that a parent has died, but whether it takes the place of that parent's consent in Hawaii is something to confirm with the Family Court clerk in your county or an attorney. The data we rely on for Hawaii does not say that a death certificate replaces consent, so we won't promise that it does. It is still an important document in this situation, and the points below show what we can say.
What a death certificate does. It is the official record that the other biological parent has died. You request certified copies from the Hawaii State Department of Health Office of Health Status Monitoring. If the parent died in another state or country, you would ask that place's vital records office. Expect the Family Court to want a certified copy with your petition, and ask the clerk exactly what form they require.
What it does not change. Several parts of a Hawaii stepparent adoption stay the same:
- Court: The petition is filed in Family Court in your county.
- Residency: Hawaii has no minimum residency period (HRS § 578-1), so you do not need to wait out a set number of months before filing.
- Child's consent: The age for a child's consent is 10 (HRS § 578-2). If your child is 10 or older, plan for that.
- Home study: Hawaii does not waive the home study (HRS § 578-8), and a death certificate does not change that.
Where abandonment fits. Hawaii's abandonment period is 12 months (HRS § 578-2). That is a separate topic from a parent's death, and it comes up when a parent is living but absent. If the other parent has died, you generally won't be dealing with abandonment. If anything about the parent's status is uncertain, such as no certificate being available or a question about who the legal parents are, that is a fact-specific issue for the clerk or an attorney.
How long it takes. A stepparent adoption in Hawaii typically takes 3-6 months. The filing fee isn't something we can quote for you, so the Family Court clerk in your county can confirm the current amount and any additional paperwork they expect.
Questions to ask the clerk:
- Whether the court wants a certified copy of the death certificate, and how recent it must be.
- How the court handles the deceased parent's consent in your case.
- Whether any other family members or relatives need to be notified.
- What the current filing fee is.
