Does a death certificate replace the consent requirement for adoption in Delaware?

A death certificate is key proof when a parent has died, but whether it replaces that parent's consent in a Delaware stepparent adoption is something to confirm with the Family Court clerk in your county or an attorney. Delaware law on how the court treats a deceased parent's consent is not something we can state for your specific situation, so here is what we can tell you about the pieces around it.

Why the death certificate still matters. It is the official record that the other parent has died, and the Family Court will want to see that fact documented. If the parent died in Delaware, the Delaware Office of Vital Statistics is the agency to ask about certified copies. If the death happened in another state or country, you would request it from that place's vital records office. Ask the clerk whether a certified copy is required and whether anything else should accompany it.

What stays the same in Delaware:

  • Court: The petition is filed in Family Court.
  • Child's consent: A child who is 14 or older has a consent role under 13 Del. C. § 907(b). A parent's death does not change a child's own consent.
  • Who can petition: For a minor adoption, the petitioner must be over age 21 when the petition is filed, and also a Delaware resident or a person with whom the child has been placed under 13 Del. C. § 904 (see 13 Del. C. § 903). Delaware has no minimum residency period.
  • Home study: Delaware does not waive the home study (13 Del. C. § 912). Ask the clerk whether anything about the process differs when the other parent has died.
  • Timeline: Stepparent adoptions in Delaware typically run about 4-6 months.

If the other parent is living but absent. This is a different situation from a death. Delaware looks at a six-month period in connection with abandonment (13 Del. C. § 1103), and ending a living parent's rights is handled as a separate process from the adoption itself. If there is any question about whether a parent is living, can be found, or might object, talk to the Family Court clerk or an attorney about that specific issue before you file.

If the death was recent. Delaware has no minimum residency period to wait out. The data we rely on does not set a separate waiting period after a death, so ask the clerk whether any timing rules apply to your case.

Questions to bring to the clerk:

  • Do I need a certified copy of the death certificate, and how recent must it be?
  • Does the court need anything else to document the other parent's death?
  • What is the current filing fee in our county?
  • Are there any steps that differ because the other parent has died?
