Yes, your spouse can adopt your child in Alabama. Alabama allows any legally married spouse to adopt their partner's child through the stepparent adoption process, and the case is filed in the Probate Court.

What you need to get started

  • Marriage: Your spouse must be legally married to you.
  • Age and residency: Your spouse must be an adult (19 or older) and a bona fide Alabama resident. Alabama sets no minimum length of residency (Ala. Code § 26-10E-5(e)(3)).
  • Age gap: The usual requirement that an adopting parent be at least 10 years older than the child does not apply to a stepparent filing.
  • Filing: The petition goes to the Probate Court. Alabama has 67 counties, so your county's clerk can tell you about any local filing practices.

Alabama requires a petition for adoption, consent forms or grounds for implied consent, and your spouse's consent to the adoption. The child's other legal parent generally either consents or the case rests on grounds for implied consent. One ground is abandonment, and Alabama sets a four-month period for it (Ala. Code § 26-10E-9(a)(1), (a)(4)). If the other parent's location is unknown, Alabama allows service by publication. If the other parent is likely to object, or whether abandonment applies is unclear, that depends on your facts. Talk to the Probate Court clerk or an attorney about that specific issue.

If your child is 14 or older, their consent is part of the process (Ala. Code § 26-10E-7(a)(1)).

Home study

Alabama does not waive the home study for stepparents (Ala. Code § 26-10E-26(2)). Plan for it as part of the process.

Timeline and cost

  • Timeline: Stepparent adoptions in Alabama typically take 3-6 months.
  • Court filing fee: The fee typically ranges from $200 to $350.
  • Total cost: The total typically runs under $1,000 when you file on your own, compared with $3,000-$5,000+ when hiring an attorney.

What changes when it's final

Once the Probate Court finalizes the adoption, your spouse becomes your child's legal parent, with the rights and responsibilities that come with that role, including inheritance and medical decisions. For questions about updating your child's birth record afterward, contact the Alabama Center for Health Statistics or your county Probate Court clerk.
