Can I adopt my stepchild in Alabama if I was previously married to someone else?

Yes. Alabama allows any legally married spouse to adopt their partner's child through the stepparent adoption process, so if you are now legally married to your stepchild's parent, that is the route you would use. Alabama's stepparent adoption rules center on your current marriage. If you want to know whether a particular earlier marriage or divorce could matter in your situation, the Probate Court clerk in your county or an attorney can confirm that for you.

What the Probate Court looks at. Stepparent adoptions in Alabama are filed in the Probate Court, and the state has 67 counties. These are the main pieces:

  • Residency: Alabama sets no minimum number of months you must have lived in the state. You do need to be a bona fide Alabama resident (Ala. Code § 26-10E-5(e)(3) and § 26-10E-5(e)).
  • Consent: The filing includes a petition for adoption, consent forms or grounds for implied consent, and your spouse's consent to the adoption. A child who is 14 or older also has a consent requirement (Ala. Code § 26-10E-7(a)(1)).
  • Abandonment: If the other legal parent will not consent, Alabama's rules on implied consent include a four-month abandonment period (Ala. Code § 26-10E-9(a)(1), (a)(4)). Whether that applies depends on your facts. For a contested case or a parent whose whereabouts are unknown, ask the clerk or an attorney about your specific situation.
  • Notice to the other parent: Alabama allows personal service, or service by publication if the parent's location is unknown.
  • Home study: Alabama does not waive this step. A DHR pre-placement investigation is part of the process (Ala. Code § 26-10E-26(2)).

Cost and timeline. Court filing fees in Alabama typically run $200-$350, and the total cost is typically under $1,000 when you prepare the paperwork yourself. Attorney-handled stepparent adoptions often run $3,000-$5,000+. A stepparent adoption usually takes about 3-6 months.

Your history and your family. Many stepparents come to adoption after earlier marriages, and the process is built around the family you have now. You are parenting this child today, and adoption makes that relationship legal.
