Unpaid child support arrears are a separate question from the steps Alabama sets out for a stepparent adoption, but what happens to the arrears themselves is something to confirm with an attorney or the Probate Court clerk in your county. Alabama stepparent adoptions are filed in Probate Court, and the focus there is on consent, or grounds for implied consent, rather than on a payment history.
What Alabama's process looks at:
- Consent or grounds for implied consent. You file a petition for adoption along with the consent forms, or with the grounds for implied consent. Your spouse, the child's parent, must also consent to the adoption.
- Abandonment. Alabama's abandonment period is 4 months (Ala. Code § 26-10E-9(a)(1), (a)(4)). Whether a parent's payments, or lack of them, matter to an abandonment claim depends on the facts of your case. An attorney can advise you on that specific issue.
- The child's consent. A child who is 14 or older must consent (Ala. Code § 26-10E-7(a)(1)).
- Residency. Alabama has no minimum residency period for filing (Ala. Code § 26-10E-5(e)(3)).
- Home study. It is not waived in Alabama (Ala. Code § 26-10E-26(2)), so plan for it whether or not support is owed.
What the arrears question depends on:
- Whether the other parent can still be required to pay past-due support after the adoption is final.
- Whether the arrears can be collected before or after you file.
- Whether the unpaid support affects the other parent's consent or your grounds for implied consent.
Alabama law on each of these points should be confirmed with the Probate Court clerk in your county or with an attorney who handles family law. Contested cases, or cases where the other parent's location is unknown, especially call for that kind of individual advice. If the arrears are significant, talk with your spouse before filing about how much weight you want to give them. Some families also get a legal opinion on how the arrears will be handled first.
What to expect on timing and cost:
- A stepparent adoption in Alabama typically takes 3-6 months.
- The court filing fee generally runs $200-$350, and the total typically comes to under $1,000. Attorney-handled adoptions often cost $3,000-$5,000+.
