Can I adopt my stepchild if the biological parent is a registered sex offender in Delaware?

Yes, a stepparent adoption may be possible in Delaware, but how the Family Court treats the other parent's sex offender registration depends on the facts of your case. That specific question should be confirmed with the Family Court clerk in your county or with an attorney. Here is what Delaware law does spell out and how it relates to your situation.

Where your case would be filed: Your petition goes to the Family Court. Delaware has no minimum residency period under 13 Del. C. § 903. That same section requires the adopting parent to be over age 21 when the petition is filed, and to be a Delaware resident or a person with whom a child has been placed under § 904.

The other parent's rights: In Delaware, termination of parental rights is handled separately from the adoption itself. Registry status is not mentioned in the Delaware provisions we work from, so whether it affects the termination or the consent question is something to ask the clerk or an attorney. Delaware's abandonment provision, 13 Del. C. § 1103, uses a period of 6 months. If the other parent has had no contact with your stepchild, that period may be relevant, but whether it applies to your family depends on the details.

If there is any contact or a dispute: If the other parent has contact with your child, objects, or the history is complicated, it is worth speaking with a family law attorney about that specific issue. The outcome depends on facts that only a court, or a lawyer who knows your records, can assess.

Your child's voice: Delaware sets the child consent age at 14 (13 Del. C. § 907(b)). If your stepchild is 14 or older, the child's consent is part of the picture.

Home study: Delaware does not waive the home study (13 Del. C. § 912), so plan for it even in a stepparent case.

Timeline: Stepparent adoptions in Delaware generally run about 4-6 months. A contested or complicated termination can change that, so the clerk can tell you what to expect locally.
