Yes, you can ask the Delaware Family Court to approve a stepparent adoption even if your stepchild's other biological parent struggles with drug addiction. What matters most is whether that parent will consent or whether there is a legal ground to go forward without consent. Addiction alone is not the question the paperwork asks. How the court weighs a parent's substance use is something to confirm with an attorney or the Family Court clerk in your county.
The main routes in Delaware
- The parent consents. Some parents who are struggling recognize they cannot parent right now and agree to the adoption. If that is your situation, the process is usually much more straightforward.
- Abandonment. Delaware's abandonment period is 6 months (13 Del. C. § 1103). If the parent has had no meaningful contact with your child for that long, abandonment may be the basis for moving ahead. The addiction may explain why the contact stopped, but the focus is on what your child has actually experienced.
- Termination of parental rights. In Delaware, termination is a separate step from the adoption itself. If the parent will not consent and abandonment does not fit, an attorney can tell you whether a termination case makes sense for your facts.
What to gather
- Dates and details showing when the parent last had contact, calls, visits, or support.
- A record of any attempts to keep the parent involved.
- Information about the home you and your spouse provide.
Clear, honest records matter whichever route applies, especially if the parent contests the adoption.
Other Delaware requirements that apply
- Court: Your petition is filed in Family Court. Delaware has 3 counties.
- Residency: Delaware sets no minimum residency period (13 Del. C. § 903). As the adopting parent, you must be over age 21 when you file, and also a Delaware resident or a person with whom a child has been placed under § 904.
- Child's consent: Delaware sets the child consent age at 14 (13 Del. C. § 907(b)).
- Home study: It is not waived in Delaware (13 Del. C. § 912), so plan for it.
- Timeline: A stepparent adoption in Delaware typically takes about 4-6 months.
- Birth certificate: After the adoption is final, the Delaware Office of Vital Statistics handles vital records.
When to get individual help
Cases involving an uncooperative parent, a parent whose whereabouts are unknown, or a parent actively in treatment depend heavily on the facts. For those questions, speak with an attorney or ask the Family Court clerk in your county. The clerk can also tell you the current filing fee, which we do not list here.
