Yes, you can pursue a stepparent adoption in Iowa when your stepchild's biological father is in prison. The adoption goes through the District Court in your county, and his sentence doesn't close the door. His parental rights do have to be addressed, either through his signed consent or through a termination petition.

Two ways to address his rights

  • Consent: If he is willing, he signs consent forms. Iowa's required paperwork includes a Petition for Adoption, consent forms or a termination petition, your spouse's consent, and the filing fee.
  • Termination: If he won't sign, or can't be reached, a termination petition is filed. In Iowa, termination is a separate step from the adoption itself.

How abandonment works here

Iowa Code § 600A.8 covers abandonment. Iowa sets no fixed number of months. The court looks at the parent's overall conduct. Whether a parent's time in prison, together with his contact and involvement with your child, amounts to abandonment depends on the facts. For that question, talk to the District Court clerk in your county or an attorney.

Notifying a father in prison

Iowa allows personal service by a sheriff or process server. If a parent's location is unknown, service by publication is allowed after a diligent search. A father in prison has a known location, so personal service is the usual route to look at first. The clerk can tell you how service works for the facility where he is held.

Other Iowa requirements

  • Residency: Iowa has no minimum residency period (Iowa Code § 600.3).
  • Your child's consent: A child who is 14 or older must consent (Iowa Code § 600.7).
  • Home study: It is waived in stepparent adoptions (Iowa Code § 600.8).
  • Timeline: Stepparent adoptions typically take 3-6 months. Iowa requires a 180-day period from filing to finalization, so your clerk can help you plan around it.
  • Cost: The court filing fee is typically $150-$250. The total is typically under $1,000 when you file without an attorney, compared with $3,000-$5,000+ for attorney-handled adoptions.

When to get individual advice

If the father is likely to contest, or if you aren't sure whether his situation meets Iowa's abandonment standard, ask the District Court clerk about procedure and an Iowa family law attorney about your case. The clerk can confirm local filing details but can't advise you on strategy.
