Can I adopt my stepchild if I work out of state but live in Michigan?

Yes. If your home is in Michigan, working out of state does not stop you from adopting your stepchild in Michigan. The Family Division of Circuit Court can grant a stepparent adoption as long as you, your spouse, or the child is a Michigan resident.

Residency:

  • Michigan has no minimum residency period for adoption petitions under MCL § 710.24(1). You do not have to live in the state for a set number of months before you file.
  • Because only one of you (you, your spouse, or the child) has to be a Michigan resident, your Michigan home is what counts for this question.
  • If your work arrangement is unusual, such as long stretches away, a second residence, or a home base that is hard to define, the Family Division of Circuit Court clerk in your county can confirm how the court sees your situation.

Where you file: You file in the Family Division of Circuit Court in Michigan, which has 83 counties. The clerk in your county can tell you which court applies to your address and how that court schedules its cases.

Planning around work travel:

  • The typical stepparent adoption timeline in Michigan is 3-6 months, so it helps to tell your employer early about any dates you may need off.
  • Home study requirements are addressed in MCL § 710.46. Ask the clerk how your county handles it, especially if you are away from home often.
  • Ask the clerk, too, about scheduling court dates around your work.

If the other parent lives elsewhere: The other parent's location does not prevent the adoption. Whether that parent must consent, or whether their rights can be ended, depends on the facts of your family. For a contested case or an unknown parent, speak with the court clerk or an attorney about your specific situation.

Cost and representation: Michigan court filing fees typically run $200-$500, and the total typical cost is under $1,000. Michigan allows you to represent yourself in a stepparent adoption, so an attorney is not required. Attorney fees often run $3,000-$5,000+.
