Can I adopt my special needs stepchild in Virginia?

Yes, as a stepparent you can petition the Virginia Circuit Court to adopt your stepchild. The steps below are the ones that apply to Virginia stepparent adoptions. How your child's particular needs fit into the case is worth confirming with the Circuit Court clerk in your county or an attorney.

The basics in Virginia

  • Court: Your petition is filed in the Circuit Court in your county or city.
  • Residency: Virginia has no minimum residency period. The petitioner must be a person who resides in the Commonwealth (Va. Code § 63.2-1201). Married persons petition jointly under that same section.
  • Child's consent: A child who is 14 or older must consent (Va. Code § 63.2-1202). If your child's disability affects their ability to give consent, ask the clerk or an attorney how the court handles that in your case.
  • Other parent's consent: You will need the other legal parent's consent or a motion to dispense with it. Abandonment is addressed in Va. Code § 63.2-1202(H), which uses a 6-month period. If the other parent is hard to find, service by publication is allowed after a diligent search. Contested or unknown-parent situations depend on your facts, so talk to an attorney about them.
  • Home study: Virginia allows abbreviated reviews for stepparents, and the home study is waived (Va. Code § 63.2-1242).
  • Timeline: Stepparent adoptions in Virginia typically take 3-6 months.

If your stepchild is now an adult

Special needs often continue past 18, and Virginia also has a separate adult adoption process. The adoptee's consent is required, and no consent of either parent is required (Va. Code Ann. § 63.2-1243). One eligible category is a stepchild to whom you have stood in loco parentis for at least 3 months. A home study is not made unless the Circuit Court chooses to require one (Va. Code Ann. § 63.2-1244). Adult adoptions typically take 4-8 weeks. Because the adoptee's own consent is required, ask the clerk or an attorney how that works if your adult stepchild has a guardian or limited decision-making capacity.

Benefits and coverage questions

Many parents of children with special needs ask how adoption affects health insurance, Medicaid, SSI, other disability benefits, or adoption subsidies. These depend on the specific program and your child's situation. Check with the agency that runs each benefit before you file, and consider an attorney for anything complicated. The Virginia Division of Vital Records can help with questions about your child's birth records.
