Yes, an older stepparent can adopt in South Carolina. The statute on who may adopt, S.C. Code Ann. § 63-9-60, says "any South Carolina resident" and sets no age. Adult adoption under S.C. Code Ann. § 63-9-1120 requires only that the adoptive parent be "another adult person." We found no age-gap rule in the adoption statutes (South Carolina Code of Laws Title 63, Chapter 9). If you are worried about how the Family Court might view a particular age, ask the Family Court clerk in your county or an attorney.
If you are adopting a stepchild under 18:
- The petition goes to the Family Court.
- South Carolina has no minimum residency period for this under S.C. Code § 63-9-60(A).
- A child who is 14 or older must consent (S.C. Code § 63-9-310).
- The abandonment period is 6 months (S.C. Code § 63-7-2570). This matters only if a biological parent's rights are at issue.
- The home study is waived for stepparent adoptions (S.C. Code § 63-9-1110(1)).
- A stepparent adoption typically takes 3-6 months.
- If the other biological parent is contested or cannot be found, the steps depend on your facts. Talk to the clerk or an attorney about that.
If you are adopting an adult stepchild (18 or older):
This is often a simpler path.
- The petition is filed in the Family Court of the county where the adoptive parents live.
- The consents needed are from the person being adopted (or that person's guardian) and, if the adoptive parent is a sole adoptive parent with a spouse, that spouse. They are filed in writing with the court. Biological parents' consent is not listed.
- A home study is not required by statute. The court may make "those investigations as the court considers advisable."
- A hearing is required. The court may enter a decree after a hearing if it finds the adoption is in the best interests of the people involved.
- The timeline is typically 4-8 weeks.
- The statute sets no relationship or prior-relationship condition for adult adoption.
Costs: Court filing fees run about $150-$350, and the total typically comes to under $1,000. An attorney can run $3,000-$5,000+.
Why families do this later in life: Many stepparents and stepchildren want to formalize a bond they have had for years. How an adoption affects inheritance, medical decisions or other rights is worth confirming with an attorney for your own situation.
