Yes. In Mississippi, an older stepparent can petition the Chancery Court to adopt. The adoption statute asks only that the person adopting be an adult and sets no numeric age for adopters. Miss. Code § 93-17-3 is the main section. If you are worried about a specific upper age, the Chancery Court clerk in your county can confirm how it is handled.
Adopting an adult stepchild. This is the route most often relevant to an older stepparent. Mississippi permits adult adoption, and the statute treats the person being adopted as the "child" even if an adult. The current text has no relationship or disability requirement. Filing is in the chancery court of the county where you or the adoptee lives, and Mississippi has 82 counties.
Consent.
- The adoptee must consent. If the adoptee is over 14, that means a sworn or acknowledged consent, or personal service as if the adoptee were an adult (Miss. Code § 93-17-5).
- If you are married, your spouse generally joins the petition. The exceptions are a spouse who does not live with you, or as the court decides.
- Miss. Code § 93-17-5 makes the parents parties to an adoption, by process or by a filed consent. We found no adult exemption there, so ask the clerk or an attorney whether a biological parent must be notified or consent in your situation.
Home study. A home study is generally required under Miss. Code § 93-17-11, with exceptions for stepparent, relative and foster-to-adopt adoptions. For a consenting adult adoptee, the chancellor may waive it. That decision belongs to the chancellor.
Residency. Mississippi's 6-month residency rule in Miss. Code § 93-17-3 is written for minors. We found no separate residency rule for adult adoptions, so confirm with the clerk how it applies to you.
If the adoptee is a minor. Age is not a listed factor, but the standard process applies. The stepparent timeline is typically 3-6 months. Contested cases, such as a parent who objects or cannot be found, depend on the facts. For those, speak with the clerk or an attorney.
Timeline and cost. An adult adoption typically takes 4-8 weeks. Court filing fees generally run $150-$300, and the total is typically under $1,000. Attorney representation commonly costs $3,000-$5,000+. Mississippi adoptions go through an interlocutory decree and then a final decree, and the clerk dockets adoptions as priority cases.
