Can an elderly stepparent adopt in Michigan?

2 min readHelping families since 2001Michigan

Yes. Michigan's adoption law lets "a person" who wants to adopt a child or an adult file a petition (MCL § 710.24(1)), and the statute language we reviewed names no minimum age or age gap for the person adopting. If you are an older stepparent, nothing in that language shuts the door on you. The petition goes to the Family Division of Circuit Court.

If you are adopting a stepchild who is a minor: Your age is not a listed requirement, but the usual steps still apply.

  • Residency: Michigan has no minimum residency period (MCL § 710.24(1)).
  • Consent: A child who is 14 or older must consent (MCL § 710.43).
  • Other parent: If the other parent has not consented, the abandonment period in Michigan is 24 months (MCL § 710.51). Whether it applies depends on your family's facts. For a contested case or an unknown parent, ask an attorney or the court clerk.
  • Home study: An investigation is part of the process (MCL § 710.46).
  • Timeline: Stepparent adoptions of minors typically take 3-6 months.

If you are adopting an adult stepchild: This is often the situation when an older stepparent wants to formalize a long-standing bond.

  • Who consents: The adult being adopted must consent. Consent by any other individual is not required (MCL 710.43(3)).
  • Parents of the adoptee: They are "interested parties" and must be given notice, unless their rights were already terminated or released or they consented. Their consent is not required.
  • Married petitioners: A married person files together with their spouse. The court may allow a married person to adopt an adult without the spouse joining, but only if all interested parties consent.
  • Investigation: The court directs a full investigation, and the written report must be filed before an adult adoption order can be entered (MCL § 710.46).
  • Where to file: The petition can be filed in the county where you live or where the adoptee is found (MCL 710.24(1), (2)(a)).
  • Timeline: Adult adoptions typically take 4-8 weeks.
  • Order: The court may enter the order once the adoptee has consented, the report is filed, and notice has been served
