Yes, you can ask the Mississippi Chancery Court to approve a stepparent adoption of a child born out of wedlock. Whether the child's parents were married at birth is not a separate step in the process we prepare. What shapes your case is your current family situation and how the other biological parent's rights are handled.

What Mississippi's process looks like:

  • Court: You file a petition in the Chancery Court in your county. Mississippi has 82 counties, and each has its own clerk's office.
  • Residency: Mississippi's residency rule is 6 months (Miss. Code § 93-17-3).
  • Child's consent: A child who is 14 or older must consent (Miss. Code § 93-17-5).
  • Home study: Mississippi waives the home study for stepparent adoptions (Miss. Code § 93-17-11).
  • Timeline: Stepparent adoptions typically take 3-6 months.
  • Filing fee: Court filing fees run about $150-$300, and total out-of-pocket costs are typically under $1,000 when you file without an attorney.

Where the birth circumstances come in: The paperwork must show how the other biological parent's rights are addressed. Mississippi's process allows for consent forms, a motion to waive consent, and service of notice. Notice can be personal service by a sheriff or process server, or publication if the person's location is unknown. Your spouse's consent to the adoption is also part of the filing.

  • If the father is on the birth certificate: Expect his role to be addressed through consent, notice, or an abandonment claim. Mississippi's abandonment period is 12 months (Miss. Code § 93-15-103).
  • If the father is not on the birth certificate: Whether he has any legal standing depends on the facts, such as whether paternity was ever established. Ask the Chancery Court clerk in your county or an attorney how the court there handles it.
  • If the father is unknown: How the court requires notice or search efforts in that situation should be confirmed with the clerk or an attorney.

A copy of the child's birth certificate is usually needed for the filing. You can request one from the Mississippi State Department of Health Vital Records. If the certificate has no father listed, or the facts are unusual, that is the time to check with the clerk or an attorney about your particular case. Contested cases, where the other parent objects, also call for an attorney's advice.
