Your citizenship or immigration status is something to confirm with the Family Court clerk in your county, or with an immigration attorney, before you file. The Hawaii requirements below apply to the stepparent adoption itself, and a clerk or attorney can tell you whether your status changes anything for your case.

Where the case is filed: Stepparent adoptions in Hawaii are handled by the Family Court, under Hawaii Revised Statutes Chapter 578. Hawaii has 4 counties, and your paperwork is prepared for the county where you file. Cities such as Honolulu, Hilo, Kailua, Kapolei and Pearl City fall within that system.

What Hawaii requires for the adoption:

  • Residency: Hawaii has no minimum residency period before you can file (HRS § 578-1).
  • Child's consent: A child who is 10 or older is asked to consent to the adoption (HRS § 578-2). A younger child does not give consent under this rule.
  • Other biological parent: The other parent's rights must be addressed, usually through their consent. Hawaii sets a 12-month abandonment period (HRS § 578-2). If the other parent is absent, unknown, or may object, speak with the court clerk or an attorney about your situation.
  • Home study: Hawaii does not waive the home study for stepparent adoptions (HRS § 578-8). Expect it to be part of your case.

Questions to put to the clerk or an attorney:

  • Does my immigration status affect my eligibility to petition as a stepparent?
  • Does the court need any extra documents from me because I am not a U.S. citizen?
  • What are the current filing fees in my county? The clerk can confirm the exact amount.
  • Does the adoption have any effect on my own immigration status? An immigration attorney is the right person to answer this.

What to expect on timing: A stepparent adoption in Hawaii typically takes 3-6 months. The exact schedule depends on your county's Family Court calendar and on whether anyone contests the adoption. An adult adoption is usually faster, at 4-8 weeks.

Next steps: Gather your marriage certificate, the child's birth certificate, and identification and status documents for you and your spouse. Then call the Family Court clerk in your county with your questions about status before you file.
