Are there any special requirements for adoption in Wisconsin?

WisconsinCourt Process & Timeline6 min readUpdated October 13, 2026
The short answer

Wisconsin's requirements for a stepparent adoption are light. You must be a Wisconsin resident married to the child's parent, but there is no minimum residency period, no child consent requirement, and the home study is waived. The other biological parent's consent is the question most families worry about. In most stepparent adoptions that parent never signs, and the judge approves the adoption anyway, usually because they stopped contact or support, can't be found, or are deceased. In our experience, about 80% of the stepparent adoptions we have completed went forward without the other biological parent's consent.

What Wisconsin requires of you

Stepparent adoptions in Wisconsin go through the Circuit Court under Wisconsin Statutes Chapter 48. Here are the requirements that apply to you:

  • You must be a Wisconsin resident. Under Wis. Stat. § 48.82(1), a Wisconsin resident can adopt as a spouse if the other spouse is the child's parent. That describes you as a stepparent.
  • There is no minimum residency period. Wisconsin sets no waiting time before you can file (Wis. Stat. § 48.82). If you live in Wisconsin now, you can start.
  • There is no stated minimum age or age gap for married adopters in Wis. Stat. § 48.82(1).
  • The home study is waived for stepparent adoptions (Wis. Stat. § 48.88). No social worker has to inspect your house before you file.
  • The child does not have to consent. If your stepchild is 14 or older, they attend the hearing unless the court orders otherwise. Younger children don't need to do anything special.
  • There is no separate termination lawsuit to file first. The other parent's rights are addressed inside your adoption case.

What happens with the other biological parent

Courts like a child to have the security of active legal parents. When one parent is no longer part of the child's life, an adoption by the stepparent who is there gives the child that security. Judges see this every day.

Here is how it usually plays out:

  • The other parent consents. They sign, and the case moves quickly.
  • The other parent has stopped contact or support. Wisconsin uses a six-month period for abandonment under Wis. Stat. § 48.415. Families in this situation are the most common, and the judge approves the adoption without that parent's signature.
  • The other parent can't be found. You give notice by the routine methods the court accepts, including publication when needed. These are standard steps, and we prepare the documents for them.
  • The other parent is deceased. You provide a death certificate and the case proceeds.

If the other parent actively shows up in court to fight the adoption, some families choose to add an attorney for that hearing. That is the exception, not the usual path.

You may also be wondering about child support. The other parent's duty to pay going forward ends at adoption. Whether past-due support can still be collected depends on Wisconsin law, so don't assume it disappears.

Timeline and court costs

Stepparent adoptions in Wisconsin generally take 3-6 months from filing to decree. The pace depends on your county, how quickly the other parent is served or located, and when the court can set your hearing.

Wisconsin has 72 counties, and each county's Circuit Court clerk handles filings. The clerk sets the filing fee, and some counties have their own local forms or procedures. Call your clerk's office to confirm the current fee and any local requirements before you file. We build your document package for your specific county, so those local details are already worked in.

Adult adoption in Wisconsin

If the person you want to adopt is an adult, different rules apply. Adult adoption falls under chapter 882, not chapter 48.

  • Who can adopt: Any adult who is a Wisconsin resident can adopt another adult (Wis. Stat. § 882.01). No relationship or age-gap condition is stated.
  • Consent: The adult being adopted must consent in writing. The petitioner's spouse must also consent if they haven't joined the petition (Wis. Stat. § 882.02). Parental consent is not listed.
  • Where to file: The Circuit Court in the county where the petitioner lives (Wis. Stat. § 882.03).
  • Home study: Not mandatory. The court enters the order after whatever investigation it considers advisable.
  • Hearing: Required, though it may be held in chambers. You and the adult adoptee attend unless the court orders otherwise. The order is granted if it is in the best interests of the people involved (Wis. Stat. § 882.04).
  • Timeline: Usually about 4-8 weeks.

What to do next

  1. Confirm the basics. You live in Wisconsin, and you are married to the child's parent.
  2. Gather what you know about the other parent. That means their last known address, when they last had contact or paid support, and whether they are living. Even partial information helps.
  3. Call your county clerk to confirm the filing fee and ask whether your county has a local form.
  4. Start your documents. Once your answers are in, we prepare the package.
  5. After the decree, the Wisconsin Vital Records Office is the agency that handles the child's birth record. We walk you through that step too.

Questions families ask next

Do I need a lawyer to adopt my stepchild in Wisconsin? No. Many families file on their own with a properly prepared document package, and that is what we prepare.

What if I don't know where the other parent is? That is common. You document your search and use the court's accepted notice methods, including publication. We prepare those documents for you.

Does my stepchild have to agree? No. Wisconsin does not require the child's consent. A child 14 or older attends the hearing unless the court orders otherwise.

Do I have to live in Wisconsin for a certain length of time first? No. There is no minimum residency period, but you do need to be a Wisconsin resident.

Will there be a home visit? Wisconsin waives the home study for stepparent adoptions (Wis. Stat. § 48.88).
